Terms of Service

1. Acceptance of terms
By creating an account or using Festvo ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including event owners, vendors, and guests.
2. Description of service
Festvo is an event management platform that allows users to manage guest lists, send digital invitations, collect RSVPs, build event websites, manage seating, create schedules, track budgets, and discover vendors. Features available depend on your subscription plan.
3. Account registration
- You must provide accurate and complete information when registering.
- You must verify your email address before accessing the platform.
- You are responsible for maintaining the security of your password and account.
- You must notify us immediately at hello@festivolabs.com if you suspect unauthorised access to your account.
- One account per person. You may not share or transfer your account.
4. Subscription plans and billing
Festvo offers three plans:
- Free: 1 main event, up to 300 guests per event. Event website publishing costs a one-time $5 fee. Does not include seating management or schedule.
- Essentials ($20/month): Up to 5 main events per month, up to 500 guests per event, all features including planning tool, seating, schedule, and free event website publishing.
- Professional ($40/month): Unlimited events and guests, everything in Essentials, QR code invitations, dedicated account manager, and SLA support.
Paid plans are billed monthly. All prices are exclusive of applicable taxes. Subscriptions auto-renew unless cancelled before the renewal date. No refunds are issued for partial months.
5. Acceptable use
You agree not to use Festvo to:
- Send spam, unsolicited messages, or bulk commercial communications to guests.
- Upload unlawful, defamatory, obscene, or infringing content.
- Attempt to gain unauthorised access to other users' events or data.
- Reverse-engineer, scrape, or systematically extract data from the platform.
- Use the platform for any unlawful purpose or in violation of any applicable law.
- Impersonate another person or organisation.
We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.
6. Guest data and your responsibilities
When you upload guest information (names, emails, phone numbers, dietary requirements), you confirm that you have obtained the necessary consent from those individuals to store and use their data for event management purposes. You are the data controller for your guests' personal data. Festvo processes this data only on your behalf.
7. Event websites
You may create a public event website using Festvo's website builder. By publishing an event website you confirm that all content (text, images, descriptions) belongs to you or you have the right to use it. Festvo is not responsible for the content of published event websites. We reserve the right to unpublish websites that contain illegal or harmful content.
Free plan users are charged a one-time $5 fee to publish an event website. This fee is non-refundable once the website is published.
8. Vendor marketplace
Festvo provides a marketplace to connect event owners with vendors. Festvo is not a party to any agreement between event owners and vendors. We do not guarantee the quality, accuracy, or availability of any vendor listing. Any disputes between event owners and vendors must be resolved directly between the parties.
Vendors listed on Festvo are responsible for the accuracy of their profiles and pricing. Festvo reserves the right to remove vendor listings that violate our policies or are reported as fraudulent.
8a. Vendor registration
To list your business on the Festvo vendor marketplace, you must:
- Have a registered Festvo account with a verified email address.
- Provide accurate business information including your business name, category, location, contact email, a description, and at least one cover photo.
- Set a realistic and current starting price and maximum price range in your chosen currency.
- Submit your listing for review. Festvo reviews all new vendor listings before they appear publicly. We may approve, reject, or request changes to your listing at our discretion.
- Only one vendor listing is permitted per Festvo account.
By registering as a vendor you confirm that you are legally authorised to offer the services described, that your business information is truthful and not misleading, and that your portfolio images are either owned by you or used with permission.
8b. Handling client enquiries
When an event owner sends you an enquiry through Festvo, the enquiry is delivered to your registered vendor email address. You are responsible for:
- Responding to enquiries in a timely and professional manner.
- Honouring the pricing and availability information stated in your listing at the time the enquiry was received.
- Communicating clearly and honestly about your services, availability, and any conditions that apply.
- All agreements, bookings, contracts, and payments made with clients are solely between you and the client. Festvo is not a party to any such agreement and has no liability for its outcome.
Festvo limits enquiries to 3 per user per vendor per 24-hour period to prevent spam. If you receive abusive or fraudulent enquiries, report them to hello@festivolabs.com.
8c. Keeping your listing up to date
You are responsible for keeping your vendor profile accurate and current. This includes:
- Pricing: Update your starting price and price range whenever your rates change. Displaying outdated or misleading prices may result in your listing being suspended.
- Availability: If you are fully booked or no longer offering services, update your profile or contact us to temporarily suspend your listing.
- Photos and portfolio: Keep your gallery images current and representative of your actual work. Do not use stock photos or images that misrepresent your services.
- Contact details: Ensure your contact email is monitored so you do not miss enquiries.
- Description and tags: Your description must accurately reflect the services you offer. Keyword stuffing or misrepresenting your category is not permitted.
Festvo may contact you periodically to verify that your listing information is still accurate. Listings that have not been updated for an extended period or that receive consistent complaints about inaccurate information may be suspended or removed.
8d. Reviews and ratings
Event owners who have sent an enquiry may leave a review and star rating on your profile. Reviews must be based on genuine experiences. Festvo does not edit or remove reviews unless they contain prohibited content (hate speech, personal attacks, or factually false statements). If you believe a review violates our policies, contact us at hello@festivolabs.com.
Attempting to manipulate your rating through fake reviews — whether by creating fake accounts or incentivising reviews — is a breach of these Terms and may result in permanent removal from the marketplace.
8e. Vendor listing suspension and removal
Festvo may suspend or permanently remove your vendor listing if you:
- Provide false or misleading business information.
- Receive multiple substantiated complaints from clients.
- Fail to respond to enquiries consistently without updating your availability.
- Use the platform to solicit payments outside of Festvo in a manner that defrauds clients.
- Breach any other section of these Terms of Service.
We will notify you by email before taking action where possible, except in cases of serious or repeated violations.
9. Intellectual property
Festvo and its original content, features, and functionality are owned by Festvo Labs and are protected by intellectual property laws. You retain ownership of all content you create and upload to the platform. By uploading content, you grant Festvo a limited, non-exclusive licence to store and display that content solely for the purpose of operating the Service.
10. Limitation of liability
To the maximum extent permitted by law, Festvo shall not be liable for any indirect, incidental, special, or consequential damages including loss of data, loss of revenue, or loss of guests' RSVPs resulting from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.
11. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses. We are not responsible for the loss of any event data due to technical failures — we strongly recommend exporting your guest list periodically.
12. Termination
You may delete your account at any time. We may terminate or suspend your account immediately if you breach these Terms. Upon termination, your right to use the Service ceases immediately and your data will be deleted within 30 days.
13. Changes to terms
We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of Festvo after the effective date constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of Sri Lanka. Any disputes arising from these Terms or your use of Festvo shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
